The Collapse of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the crisis caused by the announcement of a new 28-article proposal for ending the war appeared – temporarily – to have been contained. A senior US official spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its response: a renewed assault of aerial bombardment on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of conflicting incidents captured the harsh reality of the current period. By day, diplomatic battles are waged: hopeful statements are delivered from different nations. Immense energy is expended on restraining specific proposals. By night, Moscow brutally reminds the world that, for them, military action persists as the main instrument for achieving "settlement".

Nocturnal Warfare

As the offensive developed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is capable of detecting rocket firings from Russian territory, a capability enabled by current data. From observation points, military aircraft that had been deployed to engage hostile cruise missiles streaked across the sky – sophisticated military planes supplied to Ukraine by Western partners.

Shortly after, Kyiv's missile defense engaged: defensive missiles fired to intercept a hostile projectile. This was a sophisticated defense system at work, presumably supplied through Western nations. Every firing shakes the surroundings, causing tremors. The brief panic quickly becomes resigned acknowledgment: perhaps the hostile projectile won't strike its target this time, preventing destruction from ruin and additional electricity failures.

Continuous Dangers

Following this, a heavy machine gun engaged a unmanned aircraft close by, part of a defensive team – almost certainly imported technology. Unfortunately, the shots failed to hit the hostile drone – it continued its flight toward its objective.

Intermittently, this persisted until dawn. Kyiv greeted the daybreak reports: several casualties, devastation and infrastructure problems in many homes as a result of the night's assault. As customarily, everyone still went about their day – enduring hostilities. But those entire period encapsulated Ukraine's essential dependence on external assistance – a reliance that regional partners are clearly incapable to substitute in the near term.

Failed Diplomacy

The 28-point plan from Washington generated strong feelings, discussion and serious worry – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after prior negotiation attempts and bilateral conferences.

Every new proposal from US leadership unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually secure success. This cycle will, undoubtedly, endure.

Political Considerations

It is easy to blame specific actors of consistently pushing Kremlin's demands. But that does not seem to be the whole story. US administration works based on a principle well known to experienced diplomats: you cannot achieve through diplomacy what you have been unable to protect through force. The US administration assumes that it is unfeasible to compel Moscow to relinquish the territory that it already controls in Ukraine's southern or eastern regions.

The challenge is that while accepting these circumstances, US leadership does nothing to deter Moscow, through words or deeds, from believing that the current condition will not evolve additionally in its advantage in the months ahead.

Conflicting Perspectives

Therefore, Moscow is confident that time is on his side – that Ukraine and its allies are coming close to fatigue. Their reason to sign a deal that does not give them the largest achievable advantage is almost completely absent. There may be multiple initiatives to stop fighting, but they will carry on as long as Russia's leadership remains supremely confident in the conclusion.

On the contrary, Kyiv believes that Ukraine can still hold out, progressively conceding civilians and areas but averting a complete military breakdown until situations evolve in its advantage.

Existing Situation

Factually, there are no genuine requirements for a armistice. Now, subjective factors are becoming relevant: leadership ambitions to negotiate peace and obtain worldwide acknowledgment, and Kyiv's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the country's interests against any proposal Kyiv finds unworkable, so that their priority does not switch to domestic problems. And although their mission will now be much harder after current events, it remains very improbable that this will change their overall approach.

These opposing factors are driving the talks.

Assessment and Future

It took a just a single week to eliminate the proposed articles of the latest plan. Assertive and inconsistent approach of the matter by Washington, pushback by Ukraine and the other European countries, along with pacifying measures of diplomats, and finally, recent disclosures, all served their function.

While new proposals based on established approaches are forthcoming, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are based on Russian demands and demonstrate certain reluctance to modify developments, if they maintain solidarity and enhance their military capacity at a considerably quicker tempo. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the predictable period, largely rely on sustained allied backing.
